EAC Secretariat Raises Concerns Over Violations of Common Market Protocol

Since the Protocol’s adoption, EAC Partner States committed themselves to deepening regional integration by eliminating barriers to trade, services, and investment. The agreement explicitly prohibits unilateral measures that hinder the free movement and establishment of citizens and businesses across the region.
In a recent statement, the Secretariat reminded Member States that they are bound by the commitments outlined in the Common Market Schedule of Commitments, particularly Annex V, which governs the progressive liberalization of services. Any reversal or restriction of sectors already liberalized contradicts the spirit and letter of the Protocol.
This position was reinforced by the Sectoral Council on Legal and Judicial Affairs, following recommendations made by the Attorneys General in November 2024, reaffirming that unilateral backtracking on obligations is inconsistent with the Protocol.
To uphold the integrity of the regional single market, the Secretariat has urged all Partner States to fully comply with their commitments. It is currently conducting a compliance review and will present its findings, including any identified violations, during the upcoming meeting of the Sectoral Council on Trade, Industry, Finance, and Investment.
The EAC reiterated its unwavering commitment to a seamless and inclusive regional integration process, calling on Partner States to uphold the principles enshrined in the EAC Treaty and the Common Market Protocol.
